The Website and the Application are hereinafter collectively referred to as the "Platform (Web & Mobile Applications)".
The Company provides its services and products to you through the Platform on the condition that you comply with these Terms and Conditions as amended from time to time. If you do not accept the Terms and Conditions or do not comply with their provisions, you should not use or access the Platform and/or use the Company's services or products through the Platform (Web & Mobile Applications).
The Platform is an intermediary within the meaning of subsection (w) of Section 2 of the Information Technology Act, 2000 and visitors to the Platform (web and mobile applications)

The Site and Application are hereinafter collectively referred to as “Platform (Web & Mobile Applications)”.The Company makes available its services and products to you, through the Platform on the condition that you abide by these Terms and Conditions, as updated from time to time. If you do not accept the Terms and Conditions or you do not meet or comply with their provisions, you should not use or access the Platform and/or avail of the Company’s services or products via the Platform (Web & Mobile Applications).

The Platform is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000. Visitors to the Platform (Web & Mobile Applications) are granted a nonexclusive, limited license to use and access the content and services offered in accordance with these Terms and Conditions (the "License").

A Visitor to the platform, whether or not he/she/Transgender has made any payment for availing access and/or services on the Platform, including the general browsers of the Platform, whether registered or not, are hereinafter referred to as “User/Users” ( End User’s).

BY THE POSITIVE ACTS OF A USER ACCESSING THE PLATFORM, THE USER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW (“Terms”). IF A USER DOES NOT AGREE WITH ANY OF THESE TERMS AND CONDITIONS, HE/SHE SHOULD NOT ACCESS OR USE THE PLATFORM.

The Platform is owned and operated by Evaara Matrimony Online world class match making service provider through Internet Services, a division of Evaara private limited (hereinafter referred to as ”Company”), which term and conditions shall, for the purposes hereof, be deemed to include its subsidiaries, affiliates, partners, shareholders, directors, executives, officers, employees, agents, attorneys, brokers, mediators, trusts, temples, business executives,RO,RM,TM,BM,Distributors, franchises, accountants and any person vested with any responsibility for any task relating to the affairs of the company), with its registered office currently located at #43-121-2/1, Makka Masjid Road, Krishna Hotel Center, Ajith Singh Nagar, Vijayawada -520015.

 2. The Platform is intended only to serve as a preliminary medium of contact and information for Users who have a bona fide intention to enter into a matrimonial alliance (“Purpose”). The Platform does not purport to be a marriage or business bureau or a dating /contact website.

3. The company presumes that every User who logs on to the Platform has a bona fide intention to get married / enter into a matrimonial alliance (Web & Mobile Applications) and not otherwise. Granted a non-exclusive, limited license to use and access the content and services offered in accordance with these Terms and Conditions (the "License").

A visitor to the Platform, regardless of whether he/she has made a payment for the use of access and/or services on the Platform, including the general browsers of the Platform, regardless of whether he/she is registered or not, is hereinafter referred to as a "User/User" ("End User').

The Platform is owned by Evaara Matrimony Online, a provider of premium matchmaking services via Internet Services, a division of Evaara Private Limited (hereinafter referred to as the "Company"), to its subsidiaries, affiliates, partners, shareholders, directors, officers, employees, agents, attorneys, brokers, trustees, Temples, Managers, , and others, employees, agents, attorneys, brokers, intermediaries, trustees, temples, business managers, RO, RM, TM, BM, distributors, franchisees, accountants and any person entrusted with any duty in connection with the affairs of the Company) whose registered office is presently located at #43-121-2/1,Makka Nasjid Road,Krishna Hotel Center,Ajith Singh Nagar,Vijayawada -520015.

2. The Platform is intended to serve only as a preliminary medium of contact and information for users who have a bona fide intention to enter into a matrimonial relationship ("Purpose"). The Platform does not claim to be a marriage or business bureau or a dating/contact website.

3. Company assumes that each user who signs up on the Platform has a bona fide intent to marry/partner (web and mobile applications) and not otherwise. Under no circumstances shall the Company be responsible for any loss or damage arising from the use of the Platform or the services offered on the Platform and/or from the content published on the Platform or transmitted to the Users. The exchange of matchmaking profiles through the Platform should in no way be construed as a matchmaking offer and/or recommendation by or on behalf of the Company. The Company shall not be liable for any loss or damage incurred by any person upon/from or following a marriage relationship established through the use of the Service offered by the Company.

4. To use the Platform, you may log in using your Moble/ Facebook/Google/Any Browsers login. When you do so, you authorize us to access and use certain Facebook/Google account information that you choose to display publicly. For more information about the information we collect from users and how we use it, please see our Privacy Policy.

The Company collects information/data including, but not limited to, email ID, address, first name, last name, phone/cell phone number, date of birth, time of birth, place ,age, gender, ethnic/cultural background, generations, property net worth’s, appearance, religion, occupation, preferences, lifestyle information, general geographic location ("User Data") from Users so that they can create their profiles on the Platform (web and mobile applications). In addition, certain other health-related information, including physical and mental disabilities, is also collected. User data collected in this manner is entered into a program specifically designed to match profiles and provide users with matches based on their pre-selected/pre-defined partner preference criteria. User data is only displayed with prior user consent. The company does not collect users' financial information such as credit card/debit card numbers/bank account numbers, etc. The Company will not be able to provide access to the Platform and/or profile Users if the required User Data is not provided by Users. The User hereby consents to the use of his/her User Data displayed to other Users on the following website

?User data is uploaded by the users themselves or by one of the Evaara Matrimony offline centres, mediators, franchises, temples, churches, NGO/Trust, business partners, and associates, displayed on the platform (web & mobile applications). The Company may, at its sole discretion, include any or all of the listings notified by a User for display on the Platform in other media, including matchmaking sections on other platforms, including but not limited to print media, community associations, websites, television broadcasts, DTH/IPTV services, mobile WAP sites, etc., at no additional cost to the Users, and the Company shall not be liable for the use/publication of such information/data.

6. Users agree not to reproduce, download, publish, modify or distribute the material on the Platform unless expressly authorized in writing by the Company. Users agree not to deep link or otherwise connect to any particular page on the Platform without the prior written consent of the Company.

7. Users agree to use the Platform only for their personal purposes. The use of any content of the Platform to create derivative works with commercial motives without the prior written consent of the Company is strictly prohibited.

8. The Company shall take measures, including technical means on the Platform, to exclude robots, scripts, programs, etc. from crawling or scraping Content on the Platform. Users undertake not to circumvent these methods.

9. Any advice, recommendations or information provided on the Platform, including information provided by Users, is not necessarily accurate, true or reliable, and any reliance thereon and any action taken based thereon is entirely / solely at the risk of the relevant User. Users hereby agree that the Company may provide Users with access to the Content available on the Platform on the basis of 'AS-IS' and 'AS-AVAILABLE'. Users who wish to use the information provided in this manner are advised to conduct due diligence on the contents of the Platform on their own initiative, at their own expense and effort. The Company does not advise/recommend the User to contact/interact with other Users or rely on the data/information contained in the User's profile/photo etc. The Company shall not be held responsible or liable in any manner whatsoever for relying on any information displayed on the Platform, as the same is only intended to serve as indicators of the general scenario in the relevant field.

The Company does not authenticate, verify, control, endorse, or investigate any information or claims contained in the matrimonial listings or other content on the Platform, nor does it certify in any way that they are accurate or true. No matches or profiles are endorsed in any way, but it is implied that the information provided is solely for the purpose of creating/creating a suitable profile for the purpose of matchmaking based on the criteria for partner preferences set by the users. Those who wish to use information on the Platform must exercise all due care, effort and initiatives and should take reasonable precautions with the full and complete knowledge that all information contained in the dating ads has been placed there directly by the users of the Platform without prior notice, consent or verification from or by the Company.

Users of the Platform are prohibited from uploading, posting, transmitting, updating or sharing any information that:

(a) belongs to another person and to which the user has no right;

b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, defamatory, invasive of another's privacy, hateful, racially or ethnically offensive, disparaging, related to or inciting money laundering or gambling, or otherwise unlawful or harmful to minors in any way;

c) infringe patents, trademarks, copyrights or other proprietary rights;

d) violates applicable law;

e) deceive or mislead the addressee about the origin of the messages or transmit information that is grossly offensive or threatening; impersonate another person;

f) contain software viruses or other computer code, files or programs designed to disrupt, destroy or limit the functionality of the Platform; threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign countries or public order, or incite the commission of a criminal offence or prevent the investigation of a criminal offence; or offend another nation.

The Company may, without notice and in its sole discretion, terminate or restrict a User's use of or access to the Platform (or any part thereof) and/or remove any Content uploaded by a User for any reason at any time, including, without limitation, if the Company, in its sole discretion and judgement, believes that a User has violated or acted inconsistently with the letter or spirit of these Terms.

11. The Company is an online service provider that allows users to create their own/unique profiles, where certain personal (optional) information and User Data shall be displayed on the Platform, used by Users for the purpose. The Company shall not disclose the User Data to other users or third parties without the prior consent of the User. Although the Company shall take all reasonable precautions, the Company shall not be responsible in the event that the User Data displayed on the Platform is unauthorizedly copied, printed, published, falsified, displayed, manipulated, etc. or misused by any User. Users shall indemnify the Company against any kind of loss/damage that the Company may incur as a result of improper use of the platform/service offered by the Company.

12. By posting a partnership profile or any business or personal listing or link or any content or entry on the Platform, the relevant User making or posting such entry and the person(s) responsible for such entry or posting agree to indemnify and hold harmless the Company against any lawsuits or complaints, civil, monetary or criminal actions or suits or claims for damages (including but not limited to interest, fines and penalties) brought or brought against the Company arising out of or relating to any matter arising out of or relating to such posting/entry or any response to such posting/entry.

13. When using the Platform, Users are required to provide only truthful and accurate information, and in the case of creating a profile, Users agree to keep the information up to date at all times. The Company does not warrant or endorse the accuracy or reliability of any member/visitor profile, advice, opinion, statement or other information displayed or uploaded by the Company through the Service. Under no circumstances will the Company or its owners, employees or agents be responsible for any direct or indirect action/disclosure that may occur as a result of the online display of information in the form of unlawful material/material that may be offensive to visitors/members or is patently offensive to the online community or material that promotes racism, bigotry, hatred, or physical/mental harm of any kind to any group or individual, or transmits chain letters or junk mail or unsolicited mass mailings or spam.

The Company reserves the right to remove/delete any content/message/photo/profile or terminate the registration/membership of any user either on the basis of a complaint received from another user or on its own discovery or at its sole discretion and sentiment and it shall, without notice, cease providing the service due to any user and forfeit all other ancillary services with immediate effect along with the fee/period of registration and take appropriate legal action against such user. By posting a profile on the Platform, it is assumed that the said User has the intention to get married and in case it is found to the Company that the User did not have the intention to get married or has changed his/her intention at the time of posting the profile or subsequently, the Company reserves the right to remove/delete such profile from the Platform and initiate prosecution or take such action as may be recommended from time to time. By using the Platform, the User agrees not to post any content or views that may be considered threatening, abusive, vulgar, obscene or otherwise objectionable, or to act illegally or otherwise harass another User; post false or misleading information in his/her own profile details; impersonate another person or use the Site for commercial purposes; or interfere with or disrupt the operation of this Site, or disobey any reasonable requirements, procedures or guidelines imposed from time to time by the Company.

15. The Platform Content is not intended to induce or persuade, convince or request any person to take any action or to refrain from taking any action if such action or refrain constitutes a violation of any applicable law or regulation to which such person or action is subject.

16. The Company shall not be liable for any interactions/sharing of information, etc. between users via e-mail, chat or any other medium with other users, and the Company shall have no obligation to monitor any such disputes between users, and the Company shall not be a party to any such disputes/lawsuits, etc.

17. The Company reserves the absolute right to modify, amend or delete the content of the personals posted on the Platform at its sole discretion to ensure compliance with the rules of such posting (which may include, but are not limited to, the Company's efforts and initiatives to maximize response to personals), appearance accuracy and applicable laws, particularly those relating to the prohibition of indecent, unlawful or obscene content. The Company reserves the full right to delete any profile if it finds that the same person has created multiple profiles on the Platform. Even if different profiles have been created with the same contact details, the Company reserves the full right to delete all such profiles. If a Member refuses to give consent to a physical address verification requested by the Company, the Company has the full right to either stamp the profile "Not Verified" or delete the profile.

18. Websites to which links are provided on the Platform and their content are the sole responsibility of the operators of those websites, and Company does not recommend, authenticate, endorse, verify or certify those websites or their content or links in any way. The Company assumes no responsibility for the privacy practices employed by these other websites, and therefore recommends that users read the privacy statements of each individual website they visit. The Company also assumes no responsibility for the authenticity of the other online services displayed on the Platform that offer various services, such as a raffle to win a free trip, free tickets to win, astrology, palmistry, numerology, etc. The user of the Platform clicks and surfs on such other websites/links displayed on the Platform at his/her own risk and responsibility. Users should always keep in mind that a single click on such links/websites is through the Transmission Control Protocol (TCP) / Internet Protocol (IP) network of the said users and not through the IP of the Platform. The Company also does not recommend the Users to provide any personal information and in particular the profile ID/username of the User on the Platform on such or any other website(s).

 

19. The Company reserves the right to work with partners to provide various other online services in the future. However, the Company will never share the information/data collected from users with such partners without obtaining prior consent/permission from users. In such circumstances, the Company recommends that users read through the privacy policies of such partners before giving consent or before providing personal data to such other website(s). The Company is not privy to the privacy practices employed by its partners and assumes no responsibility for the privacy policies employed/applied by such partners. The Company also reserves the right to use/share the information/data collected from users with its partners if a user has already shared the information/data with users of the Platform.

20. The Company hereby expressly disclaims any liability or warranty or guarantee arising in any way from the existence, promotion, advertising, content, links, information or setting of the Platform. No claims for damages, refunds, lost profits or any other financial, civil or criminal claims may be brought against the Company arising out of or related to any content on the Platform.

21. Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User Communications. Company is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including injury or damage to users or other persons' computers related to or resulting from participation or downloading materials/information from the Platform.

22. Users who visit the Platform are classified by the Company as having incomplete or complete profiles. Both types may also be free or paid members. Company reserves the absolute right to modify, amend, alter, curtail or extend any privileges, rights, benefits, liabilities or responsibilities of all types of paid or free users at its sole discretion, and the same shall apply directly to all past, present and future users. The Company grants certain benefits/privileges to free users, such as contacting them for free via the "Express Interest" feature, viewing the contact information of paid users under certain conditions, etc. The extent of these benefits and even the benefits in total are at the sole discretion of the Company. The Company will determine, at its sole discretion, how many benefits it will offer to each free user. The Company will simultaneously offer different levels of benefits to different free users. Limiting the benefits for free users will be done through various means, including access restrictions, spam filters, quotas, etc.

23. Payments for the services offered on the platform are made 100% in advance. Payment for a service subscribed to by the user is non-refundable, and any amount paid will be charged. Any refund is at the sole discretion of the Company and it does not offer any guarantees as to the accuracy or timeliness of the refunds received on the Users' card/bank accounts. The Company does not guarantee the uptime of the server or the proper functioning of the applications. Everything is done to the best of the Company's knowledge and belief, and the Company's liability for losses, damages and claims is limited to the refund of the amount. The Company does not assume any liability for free services. The Company reserves the right to amend/change any or all disclaimers or these Terms at any time without prior notice. All terms/disclaimers, whether expressly stated or not, are deemed to be included when referenced. The continued use of the Platform by a User shall be deemed to be the User's acceptance of the amended Terms.

 

24. The User is solely and exclusively responsible for maintaining the confidentiality of the User Password and User Identification and for all activities and transmissions that the User conducts through its User Identification, and is solely responsible for conducting any online or offline transactions using credit/debit cards or other forms of instruments or documents to conduct such transactions, and the Company assumes no responsibility or liability for the improper use of any information related to the use of credit/debit cards used by the Subscriber online or offline. The Company shall exercise due diligence to ensure that no data/information falls into the wrong hands. The weak link in credit card transactions is secure storage

 

25. Company does not warrant that the Platform will operate without interruption or error. Company provides the Service on an "as is" basis. However, Company takes all reasonable steps to provide error-free, uninterrupted use to its users. There may be delays, omissions and interruptions in the availability of the Platform. Users acknowledge that use of the Platform is solely at their expense and risk. Company is not responsible for any interruption of services on the Platform, regardless of the reason for such interruption/suspension. The Company may discontinue or change the Services on the Platform or their availability at any time, and the User is also free to stop using the Services on the Platform at any time.

26. The Company uses third party payment gateways on the Platform, and outages of these gateways will be communicated to Users as they are. Additional currency/conversion fees/deductions/errors of payment gateways are not the responsibility of the Company Subject to monthly caps at the discretion of the Company.

34. In the event that Company receives incriminating evidence/accusations against a User from other users of the Platform, or if Company suspects misconduct by a User based on data available to it from its servers, Company reserves the right to impose restrictions on the User's account, including, but not limited to, preventing the User in question from making multiple contacts and restricting the User to contacting only members whose desired partner profile the User meets.

35. For all Services defined by a time period specified in months, 1 month equals 30 days, and for longer duration Services, the total duration in days equals the number of months multiplied by 30.

36. Company policy prohibits members from including their name and/or contact information in any form - email, phone numbers, messenger IDs, mailing address, etc. - in fields other than those in which this information is requested

42. Class Renewal People who have subscribed to Basic, Normal,Elite,VIP,Exclusive ,Premium, Pro, Pro Lite or Evaara Matrimony. Exclusive have an option to renew theirservices.However, also any unused" Contact Views" available with the original pack are carried forward except when renewing to ‘’ Basic ’’ plan, If the renewal happens before the expiry date.

Contact Views are the installation wherein members can see contact details of other members who haven't filtered rejected ignored them.However, also it's treated as a fresh class and unused" Contact Views" of the former class aren't carried forward, If a member renews his class after the expiry of current class. These conditions hold indeed if the renewal of the subscription is whisked with a special" Renewal/ Repurchase/ fidelity" offer. Purchase before or after renewal date is the only criteria which determines if unused" Contact Views" are carried forward or not.
43. Your" Name" will be visible to other members who are Evaara Matrimony Paid subscribers either if they" View Your Contact Details" or if you have transferred them an Acceptance. Information filled by a member is visible on the profile runner. 51. Consumable plans like contact views, limelight, kundli milan etc. Will expire in 1 time unless else specified.
52. Profile viewing limits, decided grounded on the class status of the stoner are subject to change at any time.
53. All class benefits like limelight, contact views etc. Will expire with the class, unless renewed before expiry.
54. transferring of Response supporter interests on behalf of Response supporter subscribers is subject to them regularly penetrating theiraccounts.However, Response supporter interests will be stopped until the subscriber accesses his/ her account, If an account isn't penetrated for further than 15 days.
55. Any profile deleted by the profile stoner can not be recaptured under any circumstances.
56. tickets generated for referrals on Jeevansathi have an expiry date of one time from the date of generation. tickets will only be awarded to the referrer and the adjudicator if the adjudicator registers from the link transferred by Jeevansathi( on Dispatch or through share options). still, tickets aren't valid for USD Payments, tickets aren't valid on Plan upgrades, pasteboard law abatements can not be combined with any other offer on the Platform and tickets can not be profited on two( 2) month and four( 4) month plans.

 

57. Unless else specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of Company( service provider) is to give access of its on- line gate to the client for the duration of the subscription period & reference to any operation, by whatever name called or any other performance obligation, if any, is to give the upper limit for consumption, which by itself, doesn't produce any fresh performance obligation upon Company.

 

58. We do housekeeping of biographies which aren't logged in for a period of 12 months. We remove all the data associated with the profile during housekeeping.
59. The pricing and the contact views distributed will be on prorata base as reckoned by Jeevansathi. The plan upgrades will be valid till the expiry of the original plan bought.
Restriction/ proscriptions
The following conduct will inter alia constitute a abuse of the Platform and are rigorously banned
i) Copying, rooting , downloading, participating, modifying, dealing , storing, distributing, making outgrowth workshop from or else exploiting any content, data, information, including biographies, class vitae, photos and/ or plates, available on the Platform and/ or any services or products of the Company, in any manner or for any purpose which is not, harmonious with the Purpose and/ or in agreement with the Terms of Use.

( iii) Gaining or trying to gain unauthorized access( inter alia by hacking, word “ mining ” or any other means) to
( a) any portion or point of the Platform or any of the services or products offered on or through the Platform which aren't intended for you;
b) any garçon, website, program or computer systems of the Company or any other third parties and/ or druggies;
( iv) Modifying the services handed through the Platform or their appearance using any technology or overlay any fresh immolation on top of similar services or pretend the Platform’s services or its functions in any manner whatsoever without unequivocal concurrence attained in jotting by approaching us atlegal@jeevansathi.com.
v) penetrating the Platform through interfaces other than those expressly handed by Company;
vi) trying to breach or violating any security or authentication measures set up by the Company in relation to the Platform and/ or trying to probe, overlook or test the vulnerability of the Company’s system or network;
( vii) Scraping, downloading( including bulk- downloading), replicating or else rooting any information or data from the Platform( by any process, whether automatic or homemade) to offer any products or services which are analogous to or may in any manner contend with the products or services of the Company;
( viii) Rear engineering, decompiling, disassembling, decoding or else trying to do any of the forenamed or inferring the source law for the point or operation or any affiliated technology or any part thereof;
( ix) Circumventing or trying to circumvent any technological protections used or employed by the Company or by any third party in order to cover the content on the Platform and/ or to count robots, spidersetc. from crawling and/ or scraping content from the Platform.
x) Bypassing or Circumventing or trying to circumvent any service limits including but not limited to Hunt limits, Captcha limits and circumstances on different triggers
( xi) snooping with or dismembering or trying to intrude with or disrupt( including by using any device, software or routine), the use of the Platform or any computer networks connected to the Platform, by any other stoner;
( xii) Developing, using or trying to use any automated program, scripts, robots, third party software or system or any analogous or original process( including spiders, robots, dawdlers, cybersurfer draw- sways/ extensions/ add- ons, iframes on third party spots, mirroring, HTML parsersetc.) to pierce, navigate, search, copy, cover, download, scrape, bottleneck or else prize or modify in any manner, any data or content from the Platform without unequivocal concurrence attained in jotting by approaching us atlegal@jeevansathi.com;
xiii) Impersonating any other person or reality, or making any misrepresentation as to your employment by or cooperation with any person or reality;
( xiv) Forging heads or in any manner manipulating identifiers in order to disguise the origin of any stoner information;
xv) Hunting, hanging , or in any manner draining any other stoner;
( xvi) Assessing an unreasonable or disproportionately large cargo on the Platform structure;

Is grossly dangerous, draining, invasive of another's sequestration, spiteful, disparaging, relating to or encouraging plutocrat laundering or gambling in any manner, any content which is or may potentially be perceived as being dangerous, hanging , vituperative, draining, scandalous, scandalous, impious, vulgar, pornographic, paedophilic, stag, or racially, ethnically, or else unlawful in any manner whatsoever;
f. Which constitutes or encourages conduct that would constitute a felonious offence, give rise to other liability, or else violate applicable law;

Evaara Matrimony is a brand owned by Evaara Matrimony Private Limited (Company) which owns, retains and has complete rights in Evaara Matrimony  and the Evaara Matrimony  Website /App/ Evaara Matrimony Service.

Evaara Matrimony acts as a platform to enable any user to themselves register on it (by filling the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of Evaara Matrimony already registered users, for seeking prospective lawful matrimonial alliances for themselves. Evaara Matrimony retail store/franchise may also be able to assist you to create your profile, however, you must have a valid/operational mobile phone number and an email id. C) In case you are a Registrant of the prospective bride/ bridegroom and has created profile in Evaara Matrimony  Website/App on behalf of them or is accessing the BM Website/App on behalf of them implies that you have taken their consent for their profile creation in Evaara Matrimony and for accessing the Evaara Matrimony Website/App.

 

2. Process for Login & Registration

A. We expect that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent photos of you which will help you to meet your parameters .We expect you to read the relevant column before keying in the details or selecting the option available or uploading the photo. You are requested not to key in details of the profile in field other than the applicable field (including mentioning id's of other platforms/websites/App or repeating your details in another fields, after filling them once in the relevant fields or others photographs. In order to serve you better if Evaara Matrimony requires additional details you agree to provide it. You may also give a missed call to any of our retail outlets/franchise phone number for us to call you back and assist you in getting your profile registered on our website/App. Further you may fill in your email id and phone number in any of our registration campaigns appearing in various websites as part of our advertisements, basis which you may receive call from our Customer Service Center and assist you in getting your profile registered on our website/App. Evaara Matrimony may also reproduce your profile information in other matrimonial websites owned by Evaara Pvt Ltd including community based websites to provide better matching Profiles to you.

 

B. If at any point of time Evaara Matrimony comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete,Evaara Matrimony shall have full right to suspend or terminate (without any notice) your Evaara Matrimony membership and forfeit any amount paid by you towards Evaara Matrimony membership fee and refuse to provide Evaara Matrimony service to you thereafter.

 

C. Evaara Matrimony also reserves the right to block the registration of your profile on Website/App, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the Evaara Matrimony  members in their profile.

 

D. Registration of duplicate profiles of the same person is not allowed in Evaara Matrimony Website/App. Evaara Matrimony shall have full right to suspend or terminate (without any notice) such duplicate profile.

 

E. You acknowledge and confirm that your registration with Evaara Matrimony and the usage of Evaara Matrimony services is with the bonafide intention of marriage and not otherwise. Evaara Matrimony Membership is restricted strictly to the registered Evaara Matrimony individual member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of Evaara Matrimony and nor use the Evaara Matrimony Service or Evaara Matrimony members data for any commercial purpose, and Evaara Matrimony reserves its right to initiate appropriate legal action for breach of these obligation.

3. Account Security or Safety

F. J. L. If the Evaara Matrimony  Member fails to update in Evaara Matrimony website/App, any change in the particulars furnished in their profile/ then the Evaara Matrimony  membership may be suspended by Evaara Matrimony at its sole discretion.

 

M. Evaara Matrimony member shall, in case of finalization of his/her/their Registrant’s marriage, delete their profile by themselves or intimate Evaara Matrimony  for removal/deletion of their profile.

 

N. Evaara Matrimony Members agree to use secure devices, software and networks in a private place for accessing the Evaara Matrimony  services.

 

O. Evaara Matrimony member shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in BM Website/App.

 

P. Evaara Matrimony  Members shall not probe, scan or test the vulnerabilities of the Evaara Matrimony  Website/App or any network connected to the Website/App nor breach the security measures instituted by Evaara Matrimony.

 

Q. You shall also not make any payment / transfer any amount to account of any Evaara Matrimony employees. All payments shall be made only to Evaara Matrimony account.

7. Medium of Communication to Evaara Matrimony Members

A. Evaara Matrimony member hereby consents for receiving communication including promotional communications through any medium of communications such as electronic mails, calls, SMS or through Whatsapp messages from Evaara Matrimony or other portals owned by Evaara Matrimony or their alliance partners.

 

B. Evaara Matrimony by its automatic system sends to its member (s) profile (s) of the prospect by way of images/ documents/ messages / links. Evaara Matrimony member confirms that the mobile number submitted to it for verification or alternative number if any provided, is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint. Evaara Matrimony  Member further confirms that even if Evaara Matrimony  Member is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from Evaara Matrimony  either to the verified mobile number or alternative number if any provided shall not be treated as promotional calls.

 

C. You are also entitled to set up your communications frequency from Evaara Matrimony , like - only on weekends or fortnightly etc. You may also opt for not getting any call from Evaara Matrimony by ticking the appropriate box in the Website/App, provided that, you agree to receive calls from Relationship Manager of Assisted Matrimony/ Elite Matrimony/VIP/NRI Matrimony service for contacting you as a shortlisted profile for their registered members.

A. belongs to another person and to which the user does not have any right;

B. is obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;

C. is harmful to child;

D. infringes any patent, trademark, copyright or other proprietary rights;

E. deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;

F. impersonates another person;

G. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nation;

H. contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource; (ix) violates any law for the time being in force.

 

11. Disputes between Members

A. Evaara Matrimony Members are solely responsible for the communications (through any medium) with prospect or vice versa. Evaara Matrimony expressly disclaims any responsibility or liability for any monetary transaction(s) or exchange(s) or interaction(s) or passing of information(s) etc. between any Evaara Matrimony members inter se via e-mail, chat, interaction, Whatsapp or any other medium of communication between Evaara Matrimony members either using website /App or otherwise.

B. Evaara Matrimony has no obligation, to monitor any such disputes arising between the Evaara Matrimony members, and Evaara Matrimony  shall not be party to any such dispute/litigation etc.

C. Evaara Matrimony is not a broker or the agent of any Evaara Matrimony  member, and Evaara Matrimony  does not partake in the exchange of any kind of discussion between the Evaara Matrimony members and prospects or the results of their discussion.

 

12. Content Right

A. You agree that all content of Evaara Matrimony belong to Evaara Pvt Ltd excluding your or third party content including advertisement on the Website/App for which Evaara Matrimony has requisite license/right in terms hereof to display the same on our Website/App.

 

B. You acknowledge that you alone are responsible and liable for the content (mandatory or optional content you provided on our website) and information including the profile details, photograph and other content(s) keyed in the relevant field of the Website/App at the time of the creation of the Evaara Matrimony profile or subsequently modified by you and also for all the post and communication (including personalized messages sent by Evaara Matrimony paid members) with other member(s). You hereby represent and warrant that you own all rights, title and interest in your content/information or have the necessary licenses, rights, consents, and permissions to provide the said content/information. However, by submitting the content/information to Evaara Matrimony, you hereby grant Evaara Matrimony a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, communicate to the public, law enforcement agencies, courts, and the Evaara Matrimony business and services, including without limitation for promoting, communicating to the public and redistributing part or all of the content/information (and derivative works thereof) in any media formats and through any media channels.

C. While Evaara Matrimony does not accept any obligation to monitor the content/information in your profile, if the content/information is found not to be in compliance with these Terms and conditions, Evaara Matrimony may delete the content/information and / or terminate or suspend your registration or (without a refund of any subscription paid by you in terms of clause 2 (b) of these terms and conditions). You agree that if the situation warrants Evaara Matrimony may at its sole discretion put restriction on any Evaara Matrimony member to other member's communications.

 

D. Evaara Pvt Ltd/Evaara Matrimony reserves the right to proceed/initiate appropriate steps under the prevailing law against infringement by violators of the its proprietary rights or for illegally copying, modifying, publishing, transmitting, distributing, performing, displaying, or selling of any such proprietary information including using it for commercial purpose in any manner whatsoever.

 

13. Third Party website

A. Evaara Matrimony member understand and agree that Evaara Matrimony may allow third parties to put up advertisements on the Evaara Matrimony application/Website and Evaara Matrimony does not control the contents of such third party advertisement on the Evaara Matrimony application/Website. Third party websites to which links are given on Website/App are not governed by these Terms and conditions and all such third party websites are governed by their own terms and conditions for use and privacy policy, and in case of conflict the terms and conditions of the third party website shall prevail. The Company does not in any manner whatsoever authenticate, endorse, verify or certify these third party websites or any contents therein. Please note that a user shall click on links to third party websites at his / her sole risk and responsibility.

 

B. The Evaara Matrimony members agrees and understands that Evaara Matrimony may also allow third parties to provide Evaara Matrimony members services on the website/App like horoscope matching etc., and Evaara Matrimony may also collect the payment for such third party services to you, and Evaara Matrimony in this regard can have revenue sharing arrangement with such third party, however in no event shall Evaara Matrimony be liable to you for such third party services.

 

C. Evaara Matrimony reserves the right to add/delete/alter/modify/suspend any or all the Evaara Matrimony Services at any time as it may deem fit, without notice. The Evaara Matrimony members are expected to see the change on the Website/App.

 

14. Limitation of liability

A. Evaara Matrimony or Evaara Pvt Ltd or its Office bearers shall under no circumstances be liable or responsible to the Evaara Matrimony member or his/her authorized Representative or Registrant or any third party for any direct, indirect, special, exemplary, incidental, or consequential damages of any character including, without limitation, damages resulting from the use of our Website/App/Third Party Website/ Evaara Matrimony services.

 

B. Evaara Matrimony informs you that the exchange of profile(s) through or by Evaara Matrimony should not in any way be construed as a matrimonial offer and/or recommendation and / or advice or guarantee given to the Evaara Matrimony member, from/ or by Evaara Matrimony.

 

C. Notwithstanding anything to the contrary contained herein, Evaara Matrimony liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Evaara Matrimony, for any specific Evaara Matrimony paid package, and no further.

 

15. Evaara Pvt Ltd/ Evaara Matrimony will not be liable in case of any wrong/improper match made due to unavailability of profiles from Evaara Matrimony / Evaara  Pvt Ltd owned other websites.

 

16. Evaara Matrimony / Evaara Pvt Ltd or its office bearers shall under no circumstances be liable, if any, for the Evaara Matrimony member entering into financial transaction with any other Evaara Matrimony  Member or any third party.

 

17. Evaara Pvt Ltd/ Evaara Matrimony or its office bearers shall under no circumstances be liable, if any, for any Evaara Matrimony members not responding/reciprocating when you approach them for matrimonial alliance.

 

18. Class Action Suits

You acknowledge and confirm that you will not bring or participate in any class action or other class proceeding in connection with any dispute with Evaara Matrimony. Further neither you nor Evaara Matrimony agrees to class arbitration.

 

19. General

In the event you file a false complaint against another prospect on our Website /App and consequently we have suspended/deleted that prospects profile based on your complaint, then we reserve our right to initiate appropriate legal (Civil/Criminal) action against you and claim any and all costs expenses from you, for such irresponsible/misrepresentation/illegal/unlawful action. We also reserve our right to suspend your profile and forfeit any and all amounts paid by you for the Evaara Matrimony services as per clause 2 (b) of these terms and conditions.

 

20. Notwithstanding anything contained herein, Evaara Matrimony reserves the absolute right to delete, in any manner as it deems fit, any content of any profile listing placed on Evaara Matrimony /website/App (once such instance come to Evaara Matrimony notice) in order to ensure, that proper consent has been obtained by you , prima facie accuracy and the prevailing laws in force for the time being, especially those relating to providing any obscene, libelous, blasphemous, slanderous, defamatory or invasive of another person’s (deceased or alive) right of privacy or publicity, or that may reasonably be deemed to be harmful, vulgar, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, nationality, gender or otherwise unfit for reproduction; or suggests or encourages unfair or illegal /indecent, unlawful activity. Evaara Matrimony also reserves the right to block/ delete / suspend the profile which might be offensive, illegal or that might violate the rights, harm or threaten the safety of our office bearers/employees (including undue communication with any employee) and/or other registered prospects or using our Evaara Matrimony website/App as a means of communication while sending messages to other Evaara Matrimony members regarding their profile identity in other matrimonial websites.

 

21. Once your paid membership expires, you cannot avail the unexpired balance phone call count/ unexpired SMS . Similarly, you cannot access the already viewed Evaara Matrimony member(s) contact information unless you renew your account within 30 days.

 

22. However on renewal, the unexpired phone call / SMS shall be carried forward to your account from the last day of expiry.

 

23. In case of conflict between the terms and condition of Website/App and terms and conditions of any other website including other websites of Evaara Pvt Ltd/Evaara Matrimony, the terms and condition of Evaara Matrimony Website/App shall prevail for the service provided through this Website/App.

 

24. Disclaimer

A. Your access to and use of the Evaara Matrimony Services or any content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE EVAARA MATRIMONY SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, EVAARA MATRIMONY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Evaara Matrimony does not warrant that the Website/App, its servers, or e-mail sent from Evaara Matrimony are free of viruses or other harmful components. Evaara Matrimony will not be liable for any damages of any kind arising from the use of this Evaara Matrimony Website/App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

 

B. Evaara Matrimony does not give any implied or explicit guarantee or warranty of marriage or alliance by you choosing to register on our Website/App and using Evaara Matrimony services (both paid and free).

C. Notwithstanding anything contrary contained anywhere, under no circumstances, Evaara Matrimony shall be held responsible or liable whatsoever or howsoever, arising out of, relating to or connected with:

i. any act or omission done by Evaara Matrimony / Evaara Matrimony  Pvt Ltd/payment gateway/alliance partner etc.;

ii. any untrue or incorrect information submitted by you or on your behalf;

iii. any decision taken by you or on your behalf or any consequences thereof, based on any information provided by any other user (including suspension/deletion of the profile from Evaara Matrimony);

iv. any unauthorized or illegal act done by any third party relating to or connected with any information submitted by you or on your behalf;

v. any cyber crime attempted or committed by anyone and

vi. any incident of force-majeure or 'act of god'.

vii. Any issue already stated in these terms and conditions including limitation of liability clause of these terms and conditions.

viii. Using/availing of third party services namely horoscope matching services etc. and for paying them through the Website.

ix. Evaara Matrimony shall not be liable for the outcome of during any interaction in a meeting, call, sms, chat, email or social media posts at any point of time

x. Any issues relating to any technical malfunction of any telecommunication network, software, hardware failures, network congestion, denial of service, failure due to spamming or any combination of the above.

D. You expressly agree that your use of this Website/App is at your sole risk.

E. We are not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, hand-held device or mobile telephones as a result of the installation or use of the app. We are not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, hand-held device or mobile telephones as a result of the installation or use of the app.

 

25. Indemnity

By using our Evaara Matrimony services you agree to defend, indemnify, and hold harmless Evaara Matrimony, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by Evaara Matrimony. This defence and indemnification obligation will survive in perpetuity.

 

26. Termination

A. We/ Evaara Matrimony in good faith reserve our right to terminate your Evaara Matrimony membership or suspend/delete your profile at our sole discretion without any notice to you and take any action as mentioned in clause 2 (b) of the Terms and Conditions, in case you

I. seek physical / financial favors from our other registered members or

II. have provided incorrect information on our website/App or

III. have committed any fraudulent/ unlawful/ illegal activities through the use of our website/App or

IV. have violated this Terms and conditions or

V. have misappropriated the name, likeness, email address, contact no or other personally identifiable information of another Evaara Matrimony member created a profile on our website /App by impersonation/ fake/ bogus/ false/ misrepresentation/ without consent of the person who’s profile is being registered or use only part information including using photo of third parties without the permission of such third parties or act with other members/employees in indecent/improper manner,

B. If Evaara Matrimony receives any complaint against you and consequently we have suspended/deleted your profile in good faith, then we shall not be liable to you in any manner whatsoever, including for any loss, costs, expenses, or consequence, if any.

C. Unless otherwise provided in these Terms and Conditions, Evaara Matrimony membership may be terminated by Evaara Matrimony / you without assigning any reasons by serving 7 ( seven) days written notice on the other, all amount paid till date by you to Evaara Matrimony shall be forfeited.

D. Upon termination / suspension of Evaara Matrimony membership, your right to use or access the Evaara Matrimony Website/App Evaara Matrimony services will cease immediately. All provisions of this terms and conditions that by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability. Termination of your access to and use of the Evaara Matrimony Services shall not relieve you of any obligations arising or accruing prior to such termination.

 

27. Jurisdiction and Applicable Law

A. The registration of Evaara Matrimony membership and all Evaara Matrimony services are deemed to have been entered into within the territorial Jurisdiction of Vijayawada, A.P, India.

B. The Evaara Matrimony Members unconditionally agree that all such disputes and / or differences if any shall be governed by the Laws of India and submitting to the exclusive Jurisdiction of appropriate court of law in Vijayawada, A.P, India.

28. Mode of Payment

A. Payment made by cash / cheque / Net Banking / Debit / Credit Card/ Paypal/ RTGS/ NEFT/ would be in accordance with the prevailing RBI guidelines. Activation of paid Evaara Matrimony service shall be subject to realization of the said payment. In case of dishonor of Cheque/demand draft; you shall be liable to pay applicable bank’s cheque/DD bouncing charges. Further Evaara Matrimony service to your account will be deactivated / suspended until you settle the value of the payment and applicable bank charges in cash.

B. Evaara Matrimony uses third party payment gateways for collection payment through credit/debit card or other payment instruments. You agree to provide us with your Permanent Account Number / Form 60/61 of the Income Tax Act, 1961 and rules thereunder in the event you choose any paid package of Evaara Matrimony Pvt Ltd, the value of such paid package being Rs.2,00,000/- [Rupees Two Lakh Only] and above from Evaara Matrimony Pvt Ltd.

 

29. Refund and Assignment

A. The payments made by any Evaara Matrimony member to Evaara  Pvt ltd by way of membership / renewal fee / auto renewal are treated as non-refundable.

 

B. Evaara Matrimony member shall not assign or transfer your Evaara Matrimony membership to any other person or entity, and such an act shall be treated as violation of terms and conditions and Evaara Matrimony shall retain their right under clause 2 (b) of this terms and conditions.

 

C. Payment once made for Evaara Matrimony or Evaara Pvt Ltd services cannot be assigned to any person/party or adjusted towards any other product or packages provided by the Company.

30. Renewal

A. We automatically renew all paid Memberships before the expiry of the term of the paid Membership. You agree that your account will be subject to this automatic renewal feature

B. When you first subscribe for your paid Membership, you acknowledge that when your paid Membership expires it will automatically renew for the duration and at the last paid price.

C. The maximum tenure of any packages will be 12 (Twelve) month. Every Evaara Matrimony packages post validity period (varies from package to package), shall be renewed.

D. If you do not want your paid membership to automatically renew, you must cancel your paid membership. In case you have to mail for cancellation, mail to cancellation.evaaramatrimony@evaaramatrimony.com

 

31. Additional terms and conditions applicable to Non- Resident Indian customers.

A. Jurisdiction

The laws of India shall be applicable.

 

B. Arbitration of Disputes.

The Parties shall discuss among themselves and resolve any disputes informally. We are interested in attempting to resolve any Disputes by amicable and informal means, and we encourage you to contact us before resorting to arbitration. If the dispute is not resolved within 30 ( thirty ) days from the date of such dispute , then such dispute may only be resolved through an individual arbitration conducted in accordance with the provisions of The Arbitration and conciliation Act, 1996, by sole arbitrator. The seat of Arbitration shall be Chennai, Tamil Nadu, India. We shall appoint the sole arbitrator. The arbitration proceedings shall be conducted in the English language

C. However, Disputes relating to infringement of our intellectual property rights, which we may elect to have resolved by means other than arbitration.

D. In case of Renewal, Customer is charged the current price that prevails and renewed is done only for 3 months duration irrespective of the past package.

 

E. Enforcement

Any proceeding to enforce this arbitration agreement may be brought in Courts of Chennai, Tamil Nadu India.

 

32. Assisted Service Guarantee is applicable only for the users:

A. Who have availed the Assisted Service for the first time.

B.Who have more than 100 matching profiles based on the partner preference set by them at the time of the Assisted Welcome Call.

C.Who have not narrowed down the partner preference, once the Assisted service starts.

 

33. Membership Packages

A.We have various premium membership packages called Elite,NRI ,Gold, Diamond, Platinum, Prime Gold, Prime Diamond, Prime Platinum, Dedicated, Meadiator, franchise, NGO and Assisted service.

B.You shall opt for any of our premium membership packages varying between one/three months to one year, till you get marriage, post marriage packages with differing price to access various premium features.

C.Each premium package has certain limitations on count of Phone number view except for Diamond and Platinum package (1,3,6,12 months). The Diamond and Platinum package (1,3,6,12 months) has unlimited phone number view but within the Fair Usage Policy limit. Viewing an accepted member's mobile number will not deduct the mobile number count (For applicable domains)

D.The members of Platinum package (3,6,12 months) can receive Personalised Messages (PMs) from Free Members. Only if PP of Platinum member matches with the Personal Interest of the free member profile this will be allowed (For applicable domains).

E.The Fair Usage Policy (FUP) limit on Phone view count and Count on Personal message for all the premium membership packages are as follows:

This is applicable only to our registered members who have availed paid services from Evaara Matrimony on or after 1.4.2023. This Contest is also applicable to registered members who renew or upgrade their services on or after 1st April 2023. This contest shall be valid till 31th march 2024 and can be extended at the sole discretion of Evaara Matrimony  Pvt Ltd. The Members understand and agree that tax, if any, shall be deducted and remitted by Evaara Matrimony  Pvt Ltd and the Member shall provide the requisite PAN numbers, id proofs and other details enabling Evaara Matrimony  Pvt Ltd  to comply with applicable laws. The decision of Evaara Matrimony  Pvt Ltd in selecting the winner for the Slogan Contest shall be final and binding on all the Members.
